Terms of Use

Bookings and payment: All bookings can be made by booking via the website or emailing kelly@avalilyproperty.comWe require full payment for reservations at the time of booking.

Any seasonal offers we run where a deposit is supported, the final balance must be paid 30 days priors to your stay.

Cancellations: You may give notice to cancel your booking at any time provided you do so in writing. The following cancellation charges will apply:

  • More than 14 days: 100% refund
  • Less than 14 days, but no less than 7 days: 50% of full balance
  • Less than 7 days: No refund

We reserve the right to cancel the booking any time in the event of circumstances beyond reasonable control or its necessary to undertake essential works at the property. In the event of such cancellation we will refund in full all monies received for the booking. We will not otherwise be liable for any loss incurred by you as a result of the cancellation.

Changing a booking: We will endeavour to assist you in a transfer of a booking to an alternative date or duration at your request. Changes cannot be accepted with less than 7 days of the start of the holiday.

Force Majeure: We cannot accept responsibility or pay any compensation where the provision of the holiday is prevented or affected by reason of circumstances which amount to “force majeure”. These include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the property through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic, pandemic and all similar situations beyond our control.

We recommend that you take out holiday cancellation insurance.

Check in and out: Information about keys and how to access them will be provided once full payment of your booking has been received. Check in time is 4pm and check out is 10am on the day of departure, unless otherwise agreed.

You will be provided with a welcome book prior to your arrival which will include important information about your stay. Please ensure that you and your party read it carefully before arrival. You must ensure that you and your party familiarise yourselves with the layout of the accommodation and know what to do in the event of fire. There will be a full copy held at the cottage.

Parties: We have a strict ‘no parties’ policy. This is a residential area and we highly respect the peace and comfort of our neighbours. Please keep noise to a minimum between the hours of 9pm and 7am.

Breakages: Guests are asked to take good care of the property, furnishings and fittings and to leave the accommodation in the same clean, tidy condition as it was found in.  Any accidental damages or breakages must be reported to the property owner prior to departure. The property owner retains the right to make any additional charge and request payment for damage or breakages, withstanding minor breakages or ‘wear and tear’ as decided by the property owner. We reserve the right to enter the accommodation at reasonable times for the purpose of inspection or to carry out necessary repairs.

Complaints: Any complaints must be made known to the property owner immediately, where upon the property owner will endeavour to resolve any issues that may have arisen. No complaints will be entertained at the end of the hiring period or after the holidaymaker has departed.

Number of guests: The maximum number of people entitled to stay at the property is 5 and only those people named on the booking form are entitled to stay. If it's found that more people than agreed are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without a refund. Sub-letting or assignation of the let is strictly prohibited.

Dogs: Two well behaved small to medium dogs are allowed at the property. Dogs must stay downstairs and are not permitted to be left alone in the property. On booking please advise if you are bringing your dog/dogs. You will not be charged any additional fees, but should still advise us.

Smoking: Smoking of any kind is not permitted in the house, including vaping. Tea lights and candles are also not permitted due to fire safety regulations.

Liability: All responsibilities are your own. The property owner takes no responsibility for the personal possessions of the holidaymaker or the holidaymakers party. Vehicles and personal possessions are left entirely at the risk of the holidaymaker’s.

You must be 18 years of age or over to make a booking and accept full responsibility for all payments due for the consequences of any actions of all persons who will use 28 Millgate during your holiday. Once you make payment you will have deemed to have read all the Booking Conditions and agreed to be bound by them.

This agreement is for the purpose of a holiday rental only and does not create the relationship of Landlord and Tenant between you and the property owner. You will not be entitled to a tenancy or to any form of statutory security of tenure as a result of this agreement.
